Commercial litigation
Commercial disputes demand a strategic understanding and business knowledge. We have extensive expertise in relation to both (impending) commercial disputes involving business contracts, such as sales, collaboration, distribution, franchising and agency agreements, as well as disputes pertaining to non-contractual liability.
Dirkzwager’s litigation lawyers act on behalf of businesses, including financial service providers, energy suppliers, IT enterprises, healthcare & educational institutions, and insurers. We also represent clients in class action litigation.
Financial litigation
Financial institutions are increasingly facing legal disputes. Ranging from those involving breaches of the duty of care and complex financial products, such as interest rate derivatives, to issues pertaining to consumer loan agreements, the termination of credit relationships and investment advice. Legal assistance is also often required for ESG disputes and pension matters. We represent institutions such as credit providers, insurers, and investment firms, as well as (semi-)public organisations and large corporations, require specialist legal expertise in the case of (potential) breaches of the duty of care.
Dirkzwager combines an in-depth knowledge of the financial sector with legal expertise. Our specialists conduct litigation before both civil courts and complaints institutes such as the Dutch Financial Disputes Institute (Kifid). Corporate litigation

Alternative dispute resolution
In addition to normal legal proceedings, various alternative dispute resolution (ADR) methods are also available. In particular, Dirkzwager provides support in the case of arbitration, binding opinions and business mediation.
Our specialists have extensive experience of looking after our clients’ interests and they regularly serve as arbitrators, binding advisers or mediators. They litigate before the Netherlands Arbitration Institute (NAI), the Arbitration Board for the Building Industry (Raad van Arbitrage in Bouwgeschillen) and the Healthcare Arbitration Tribunal (Scheidsgerecht Gezondheidszorg), as well as before various dispute resolution boards, amongst other things.
